Title IX Grievance Procedure

Any person may report sex discrimiation, including sexual harassment (whether or not the person reporting is the person alleged to be the victim of conduct that could constitute sex discrimination or sexual harassment), in person, by mail, by telephone, or by electronic mail using the Title IX Coordinator’s contact information, or by any other means that results in the Title IX Coordinator receiving the person’s oral or written report.  Reports may be made at any time, including non business hours by using the electronic address, mailing address or telephone number listed below.

When a report of sexual harassment is made to any school employee, the Title IX Coordinator shall promptly contact the suspected victim (complainant) to discuss the availability of supportive measures, inform the complainant of the availability of supportive measures regardless of the filing of a formal complaint and discuss the process of filing a formal complaint.

Following the Formal Complaint of Sexual Harassment

 The District shall: 

  • Provide an offer of supportive measures to both the complainant and the respondent
    • The Title IX Coordinator shall meet with both the complainant and the respondent to offer supportive measures. Such measures are designed to restore or preserve equal access to the district’s education program or activity without unreasonably burdening the other party, while protecting the safety of all parties and the district’s educational environment; and deterring sexual harassment. 
  • Provide written notice to both parties including any informal resolution process that provides
    • The allegations that may constitute sexual harassment
    • The identities of both parties involved
    • The date and location of the alleged harassment (if known) 
  • Conduct an objective investigation of the alleged harassment allowing both parties to review and respond to all evidence collected
    • The formal complaint must be dismissed if the conduct alleged in the complaint would not constitute sexual harassment, did not occur during a school activity or program, or if it did not occur in the United States
  • Provide information to both parties regarding the use of informal resolutions
  • Prepare a written report of the findings of the investigation
  • Using the preponderance of evidence, provide a decision on each allegation of sexual harassment with any disciplinary actions to be taken as a result
  • Provide the process for appealing the final decision

  The District will seek to conclude the grievance process within 90 days of the complaint
